By accessing or using Animly ("the Platform"), you agree to be bound by these Terms of Service and all disclaimers contained herein. If you do not agree, you must immediately stop using the Platform. Your continued use of the Platform constitutes irrevocable acceptance of these Terms in their entirety.
Animly is a technology platform that facilitates connections between supporters and animal shelters. The Platform is strictly an intermediary — it is NOT a charity, shelter, rescue organization, or financial institution. We do not own, operate, or control any shelter listed on the Platform.
You must provide accurate information when creating an account. You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to create an account. Animly is not responsible for any unauthorized access to your account.
All purchases on Animly are donations to the platform. Coins are donation credits that let you direct your support to the shelters and animals you care about. Coins allocated to a shelter are non-refundable. Unallocated coins at the time of account deletion are donated to the Emergency Pot. A platform fee applies to each purchase as disclosed at checkout. Animly does not guarantee that donated funds will be used for any specific purpose by the receiving shelter.
Shelters must complete a verification process and maintain accurate information about their operations, animals, and use of funds. However, verification does not constitute an endorsement, guarantee, or warranty of any shelter's legitimacy, operations, financial practices, or animal welfare standards. Shelters that misrepresent information may be removed from the Platform.

All content on the Platform, including text, graphics, logos, and software, is the property of Animly or its licensors and is protected by applicable intellectual property laws.
THE PLATFORM IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANIMAL SUPPORT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Animly acts solely as a technology intermediary. We do not control, endorse, or assume any responsibility for the actions, content, products, services, or practices of any shelter, campaign, or user on the Platform. We make no representations or warranties regarding the accuracy of any shelter's claims, the welfare of animals, or the use of donated funds. Any reliance on information provided by shelters is at your own risk.
Shelters and users are solely responsible for all content they upload, including photos, descriptions, campaigns, and updates. Animly does not pre-screen, verify, or endorse user-generated content and assumes no liability for content posted by third parties. We reserve the right — but have no obligation — to remove content that violates these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANIMAL SUPPORT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PLATFORM — REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF ANIMAL SUPPORT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE PLATFORM IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless Animly and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content you upload or submit; or (e) your interaction with any shelter, campaign, or other user.
The Platform integrates with third-party services including Stripe for payment processing and Supabase for data storage. Animly is not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is governed by their respective terms of service and privacy policies.
Animly does not guarantee any specific outcome from donations made through the Platform. We do not guarantee that animals will be saved, treated, adopted, or cared for in any particular manner. We do not guarantee that shelters will use funds as described in their campaigns. While we take reasonable steps to verify shelters, we cannot monitor or control the day-to-day operations of any shelter.
The Platform employs automated systems to moderate content and enforce community guidelines, including automatic suspension of campaigns and shelter accounts based on violation reports. These automated actions are not a guarantee of accuracy and may result in false positives. Animly is not liable for any damages resulting from automated moderation decisions.
Animly shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, internet or infrastructure failures, or third-party service outages.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law.
We reserve the right to update these Terms at any time without prior notice. Changes take effect immediately upon posting. Continued use of the Platform after changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

You may delete your account at any time from your profile settings. Upon deletion: (a) any active subscription is canceled immediately; (b) remaining coins are donated to the Emergency Pot; (c) your account enters a 30-day soft-delete period during which you may restore it by signing in. After 30 days, your account data is anonymized and your authentication record is permanently removed. Restored accounts retain badges and donation history but do not recover coins or subscriptions.
Every transaction on Animly — whether a one-time contribution or a recurring donation — is a charitable donation. All donations are final and non-refundable. You may cancel your recurring donation at any time to stop future charges, but no refund will be given for donations already made. Your remaining coins stay in your wallet so you can continue directing your support to shelters and animals.
Recurring donations are billed monthly on the date of your initial donation. If a payment fails, your recurring donation enters a grace period during which we will automatically retry the payment. During this period, your existing coin balance is unaffected, but no new coins will be credited until payment is resolved. If all retry attempts fail, your recurring donation will be canceled. You may update your payment method at any time from your Wallet page. All transactions are processed in USD. If your payment method uses a different currency, your bank may apply a currency conversion fee. Animly does not control or compensate for third-party conversion fees.
